By downloading, installing, or using the Tocco application ("App"), you agree to be bound by this User Agreement ("Agreement") and our Privacy Policy. If you do not agree to these terms, you may not use the App. This Agreement constitutes a legal agreement between you and the developers of Tocco ("we", "us", or "our").

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to your compliance with this Agreement. You agree not to:

• Modify, reverse engineer, decompile, or disassemble any part of the App
• Distribute, sublicense, or transfer the App to any third party
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the operation of the App

You are responsible for maintaining the confidentiality of your device and any access credentials used with the App. You agree to notify us immediately of any unauthorized use of your device or any other breach of security. You acknowledge that you are solely responsible for all activities that occur through your use of the App.

You warrant that all financial data you input into the App is accurate and complete to the best of your knowledge. You are solely responsible for any decisions based on the information provided by the App.

Your financial data is stored securely on your device as described in our Privacy Policy. We do not have access to your personal financial information unless explicitly provided by you for support purposes.

You acknowledge that while we implement security measures to protect your data, no method of electronic storage is 100% secure, and we cannot guarantee absolute security of your data.

All intellectual property rights in the App, including but not limited to copyrights, trademarks, patents, and trade secrets, are owned by us or our licensors. This Agreement does not grant you any rights to use our intellectual property except as necessary to use the App as permitted herein.

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

The App is intended for informational purposes only and does not constitute financial advice. You should consult with a qualified financial professional before making any financial decisions.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising out of this Agreement shall not exceed the amount you paid to download the App, or $50 if you downloaded it for free.

We reserve the right to modify this Agreement at any time. When we make changes, we will update the "Effective Date" at the top of this Agreement. Your continued use of the App after the effective date of any changes constitutes your acceptance of the modified Agreement.

We may terminate this Agreement and your access to the App at any time, with or without cause. Upon termination, you must cease all use of the App and delete it from your device. Sections 4, 5, 6, 7, 9, 10, and 11 shall survive termination.

This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles. Any disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
